The attorneys at McElfish Law firm have decades of experience working with all sizes and specialties of insurers, sureties, carriers, brokers and third party administrators to successfully meet our clients’ needs and expectations. We have substantial experience in the areas of reinsurance and excess liability demutualizations and conversions, public & private transactions, regulatory compliance, licensure, formation of companies and holding companies, due diligence investigations, shareholder matters and stockholder meetings, preparation of general commercial contracts, corporate governance, reinsurance and excess liability, reinsurance and excess liability, reinsurance arbitrations, off-shore captives, administrative law, restructuring, coverage, business planning, fidelity and surety, professional liability defense, insurance insolvency, investigation  prosecution, commercial litigation, recovery, settlement and negotiation.

In addition to underlying defense, we act as exclusive coverage counsel on several primary and excess liability, non-trucking and cargo programs for various insurers and reinsurers. As part of our function, we are asked to review the claims asserted, the policy language, issue reservation of rights letters, request additional investigation, issue coverage opinions to the carrier and denials of coverage to the insured, answer department of insurance complaints, hire underlying defense counsel and file and respond to declaratory judgment actions.

Often, we are asked to review policy language for changes or revisions and have in fact written or rewritten policy language and endorsements. We also consider the effect of any federal or state filing endorsements such as the MCS-90 or the CA DMV67 that are applicable to the subject policies and their effect on the insurer's exposure.
